Mortban Terms of Service
Effective November 3, 2026
These terms are a contract between you and Bit Byte Labs LLC (“we” or “us”), and they cover the Mortban website and app. By creating an account or using Mortban, you agree to them and to the Privacy Policy.
Please read “Disputes” below. It requires individual arbitration for most disputes and gives up class actions, unless you opt out within 30 days.
Who can use Mortban
You can use Mortban if you’re at least 18, you’re in the United States, you can enter a contract, and US law doesn’t bar you from using it.
Your account
An account is for one person. You sign in with a link sent to your email, so anyone who can read that inbox can get in. Keep your email secure and up to date, and tell us right away if you think someone else got into your account. You’re responsible for what happens in your account unless we caused the problem.
What Mortban is, and isn’t
Mortban is a tool for tracking your spending and planning your money. It helps you see what’s left. The decisions stay yours.
- Not a bank. Mortban doesn’t hold, move or pay money. It isn’t a bank, a lender or a payment service.
- Not advice. Nothing in Mortban, including Mort’s notes, suggested amounts and scenarios, is financial, investment, tax, credit or legal advice. We aren’t your adviser or fiduciary. Talk to a professional about decisions that matter.
- The numbers are arithmetic. Left to spend, pace, savings, net worth and the nest jar are worked out from what you entered and what your bank reported. They’re only as good as that data. Some earlier balances are estimates, offline views can be out of date, and bank data can be late or wrong. Check your bank before you rely on a number.
- Reminders aren’t guarantees. Due dates, Coming up and notes are there to help, and one might not arrive. You’re responsible for paying your bills and watching your accounts.
Free and Plus
Free costs $0 and isn’t a trial. We won’t charge you or move you to a paid plan unless you choose one.
Plus isn’t open yet. The rest of this section applies once it is. Current features are listed on the Pricing page.
Price. Plus is $72 a year (the same as $6 a month) or $8 a month, plus any tax. The price shown at checkout is what you pay. Stripe handles payment, and Stripe’s terms apply to it.
Free trial. Plus comes with one 14-day free trial per person, and no card is needed. When it ends, your account moves to Free unless you’ve subscribed. You aren’t charged for the trial.
PLUS RENEWS AUTOMATICALLY. When you subscribe, you authorize us to charge your payment method at the start of each monthly or yearly period, at the price then in effect, until you cancel. We’ll confirm these terms and how to cancel by email after you subscribe. We’ll also email you about 30 days before each yearly renewal.
Cancelling. Cancel online from Settings at any time. Cancel before the renewal date to avoid the next charge. You keep Plus until the end of the period you paid for, and then your account moves to Free.
Refunds. Cancelling stops the next renewal, and you keep Plus until your renewal date, so we generally don’t refund a payment or part of a period. If something looks wrong, such as a duplicate charge, a charge after you cancelled, or a renewal you didn’t mean to keep, email [email protected] within 30 days of the charge and we’ll review it. We’ll refund billing errors, and other requests are up to us. If we end Plus or close your account without you having broken these terms, we’ll refund the unused part of a yearly payment. We’ll also give any refund the law requires.
Price changes. We’ll email you at least 30 days before a new price applies to your next renewal, so you can cancel first.
Failed payments. If a payment fails, we may try again. If it keeps failing, your account moves to Free.
Moving to Free. This never deletes your jars or history. Your bank connections are removed, so you’d connect them again if you come back to Plus. CSV import locks, imported history stays, and extra plans become read-only.
Bank connections
Bank connections come with Plus and are optional. When you connect a bank, you authorize us and Plaid to access balances and transactions for the accounts you choose, on your behalf, until you disconnect. Only connect accounts that are yours or that you have permission to connect.
Plaid is a separate company, and its own terms and privacy policy apply to what it does. We don’t control Plaid or your bank. Connections can break, need you to sign in again, or stop working for a particular bank. Imported data can be late, incomplete or wrong, which is why imports don’t count until you confirm them.
Your data
What you put into Mortban stays yours. You let us store and process it only to run Mortban for you, as the Privacy Policy describes. We will never sell it.
You can export your data to CSV on every plan. Mortban isn’t a backup of your financial records, so keep your own copies of anything you need.
Fair use
Don’t:
- Use Mortban to break the law, or use someone else’s account or financial data without permission.
- Try to reach other people’s data, or get around security, plan limits or rate limits.
- Overload the service, scrape it, or run automated sign-ups.
- Copy, resell or reverse engineer Mortban, except where the law lets you.
Found a security problem? Report it to [email protected] and give us a chance to fix it.
Mortban has limits, such as how many banks, accounts and transactions an account can hold. They exist to protect the service and are set well above ordinary use.
What’s ours
The Mortban name, Mort, the design and the software belong to us. We give you a personal, non-transferable right to use Mortban under these terms. If you send us an idea or feedback, we can use it without owing you anything.
Changes to Mortban
Mortban will change over time. We can add, change or remove features. If we make a major cut to what Plus includes, we’ll tell you first. If we ever shut Mortban down, we’ll give you at least 60 days’ notice so you can export your data.
Ending your account
You can leave whenever you like by deleting your account from Settings. That removes your data as the Privacy Policy describes, and it can’t be undone.
We can suspend or close an account if you seriously or repeatedly break these terms, if we need to for security or legal reasons, or if your use puts other people at risk. We’ll tell you and give you a chance to export your data, unless the law or a security risk prevents it. The parts of these terms that should last after an account ends do, including ownership, disclaimers, limits on liability and disputes.
Disclaimers
TO THE EXTENT THE LAW ALLOWS, MORTBAN IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON’T PROMISE THAT MORTBAN WILL ALWAYS BE AVAILABLE OR ERROR-FREE, OR THAT ANY NUMBER, BANK DATA OR REMINDER WILL BE ACCURATE OR ON TIME.
Limits on our liability
TO THE EXTENT THE LAW ALLOWS, WE AREN’T LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, MISSED PAYMENTS, LATE FEES, OVERDRAFTS, OR DECISIONS YOU MAKE BASED ON MORTBAN.
TO THE EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO MORTBAN IS LIMITED TO THE GREATER OF $50 OR WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
These limits don’t apply to fraud, gross negligence, willful misconduct, or anything else the law doesn’t let us limit. Some states don’t allow certain limits, so some of this may not apply to you.
Disputes
Talk to us first. Email [email protected] with your name, account email and what you’d like done. We’ll both try in good faith to resolve it for 30 days before starting anything formal.
Arbitration. If that doesn’t work, you and we agree to resolve any dispute relating to Mortban or these terms by binding individual arbitration, not in court. The American Arbitration Association runs it under its Consumer Arbitration Rules, and the Federal Arbitration Act governs this agreement. The hearing can be held by video or phone, or in the county where you live. Fees are paid as those rules provide.
What can still go to court. Either of us can bring an individual claim in small claims court. Either of us can also ask a court to stop infringement or misuse of intellectual property or a security breach.
NO CLASS ACTIONS. YOU AND WE MAY BRING CLAIMS ONLY INDIVIDUALLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION, AND YOU AND WE GIVE UP THE RIGHT TO A JURY TRIAL FOR CLAIMS THAT GO TO ARBITRATION. If a court decides this paragraph can’t be enforced for a particular claim, that claim goes to court, and the rest of this section still applies to the others.
Opting out. You can opt out of arbitration and the class action waiver by emailing [email protected] from your account’s address within 30 days of first agreeing to these terms. Opting out doesn’t affect anything else in these terms.
Governing law
The laws of the State of Georgia govern these terms, apart from its conflict of law rules. Consumer protection rights in the state where you live that can’t be waived still apply. Claims that aren’t arbitrated go to the state or federal courts in Georgia, unless your state’s law gives you the right to bring them where you live.
Changes to these terms
We’ll post any change here and update the date at the top. For a change that matters, we’ll email you at least 30 days before it takes effect. If you keep using Mortban after that, the new terms apply. If you don’t agree, you can leave before then. Changes don’t apply to disputes that already exist.
The rest
These terms and the Privacy Policy are the whole agreement between us about Mortban. If part of them can’t be enforced, the rest stays in place. If we don’t enforce something right away, we haven’t given up the right to. You can’t transfer your account or these terms. We can transfer them if Mortban is merged, sold or reorganized. We can send you notices by email or in the app.
